1. State-Specific Privacy Notice
Certain states in the U.S., including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights related to their Personal Data (or “Personal Information” as defined by privacy laws). More information on these rights and how you may exercise them is detailed below.
1.1 Your Privacy Rights
Although some of these rights apply generally, many of these rights will only apply to limited individuals or circumstances. To the extent that these laws apply, you may exercise the following rights:
1.1.1 Right to know and right to access
You have a right to know how we process and share your Personal Data, which is described in this Privacy Policy. If you have any additional questions, you can contact us at the information provided below. You may also have the right to request that we disclose certain information to you about our collection and use of your Personal Data. Once we receive your request and confirm your identity , we will disclose to you, where required by law:
- the categories of Personal Data we collected about you;
- the sources from which we collected Personal Data about you;
- the business or commercial purposes for which we collected, disclosed, “sold” or “shared” such Personal Data and the categories of Personal Data that we “sold” or “shared” about you and the categories of third parties to whom your Personal Data was “sold” or “shared”, by category or categories of Personal Data for each category of third parties to whom the Personal Data was “sold” or “shared”;
- the categories of Personal Data about you that we disclosed and the categories of third parties to whom such Personal Data was disclosed; and
- the specific pieces of Personal Data we have collected about you.
1.1.2 Right to correct
You have the right to request that we correct your Personal Data if you think they are inaccurate, taking into account the nature of the Personal Data and the purposes of processing of the Personal Data. Upon your verified request , we will use commercially reasonable efforts to correct your Personal Data and will direct our service providers to do the same.
1.1.3 Right to delete
You have the right to request that we delete the Personal Data that we have collected from you and retained, subject to certain exceptions. We will use commercially reasonable efforts to honor your request, in compliance with applicable laws. Please note, however, that we may need to keep such information if an exemption applies. Below is a list of such exemptions. Once we receive your verified request, we will delete your Personal Data (unless an exemption applies) and will direct our service providers to do the same.
Where allowable by law, we may deny your deletion request if retaining the Personal Data is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the Personal Data, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with applicable law, or otherwise perform our contract with you;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
- Debug products to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another consumer to exercise their free speech or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.) or other applicable laws;
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the Personal Data’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; and/or
- Comply with a legal obligation.
1.1.4 Right to Data Portability
You may be entitled to receive the Personal Data that you have provided to us in a structured, common and machine-readable format and to transmit it to another business or entity.
1.1.5 Right to opt out of targeted advertising or profiling
You may opt-out of our use of your Personal Data for targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects.
1.1.6 Right to opt-out of sale to or sharing with third parties
You have the right to direct us to stop disclosing your Personal Data to third parties for monetary or other valuable consideration such as cross-contextual behavioral advertising. At any time, you can also use our cookie preference tools to manage what kinds of cookies and other tracking technologies you’re comfortable with. You can also disable cookies altogether by adjusting the settings on your browser. However, if you choose to disable some or all cookies, many parts of our services may no longer work.
1.1.7 Right to consent to the use of Sensitive Personal Data or right to limit use and disclosure of Sensitive Personal Data
State laws including Connecticut and Colorado provide residents with the right to consent to the use of Sensitive Personal Data before it is used.
California Law provides its residents with a right to limit the use and disclosure of Sensitive Personal Data. However, we do not currently collect, use or disclose Sensitive Personal Data triggering California Law’s opt-out requirements.
1.2 Other State Rights
1.2.1 California Privacy Rights
Pursuant to California’s “Shine the Light” law, California residents who share Personal Data with us have the right to request and obtain from us once per year, free of charge, a list of the third parties to whom we have disclosed their Personal Data (if any) for direct marketing purposes in the prior calendar year, as well as the type of Personal Data disclosed to those parties. If you would like to exercise this right, please use the contact information listed under Section 8.3. We note that without your explicit consent Miele does not disclose your Personal Data to third parties for such third parties’ own marketing purposes.
1.2.2 Nevada Privacy Rights
Nevada Law provides its residents with a limited right to opt-out of the sale of Personal Data following Chapter 603A of the Nevada Revised Statutes. Residents who wish to exercise such opt-out right may submit a request by contacting us via email at dataprotectionus@mieleusa.com . However, please note that we do not currently sell Personal Data triggering the statutes opt-out requirements.
1.3 Exercising your rights
You may exercise our rights mentioned above as follows:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Data. You may also make a verifiable consumer request on behalf of your minor child.
Miele may reject data portability requests that are manifestly unfounded, excessive or repetitive, or where otherwise allowable by law.
The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative. Such information or documentation may include:
- Certain Personal Data about you that we have on file (e.g., postal address) or information related to the purchases you made on the Website.
- Certain information or certification showing our authority or relationship to the person on whose behalf you are submitting the request.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
Where we are entitled or required to verify your identity under the applicable state privacy law, we cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you. In such case, we will inform you that your identity cannot be verified.
Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
1.3.1 Response timing and format
We will confirm receipt of your verifiable consumer request within ten (10) business days after receiving your request and provide information about how we will process it. We respond to a verifiable consumer request no later than forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. For requests under the California’s Shine the Light Law (see below), we will respond within thirty (30) days of receipt of your request.
We will deliver our written response by mail or electronically, at your option (depending on how you make your request).
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily usable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
1.4 Appealing Privacy Rights Decisions
Depending on your state of residency, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted via email to dataprotectionus@mieleusa.com.
1.5 Non-discrimination
We will not discriminate against you for exercising any of your rights pursuant to Privacy Policy. Unless permitted by law, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
- Provide you a different level or quality of goods or services; or
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
1.6 Minors
We do not sell the Personal Data of consumers we know to be less than 18 years of age, unless we receive affirmative authorization from the parent or guardian of a minor less than 18 years of age .
If you wish to remove the name or comments of your minor child from our website or publicly displayed content, please contact us directly at dataprotectionus@mieleusa.com. We may not be able to modify or delete your information in all circumstances.
If you wish to submit a privacy request on behalf of your minor child in accordance with applicable jurisdictional laws, you must provide sufficient information to allow us to reasonably verify your child is the person about whom we collected Personal Data and you are authorized to submit the request on your child’s behalf (i.e., you are the child’s legal guardian or authorized representative).
1.7 Notice of Financial Incentives
Use of Rebates is subject to the terms, conditions and limitations stated on the sign-up window as may be amended by Miele from time to time. You can also find such example terms on the Rebate Redemption section of the website.
The promotions provided to you under the Rebates may be deemed as a “financial incentive” under applicable laws. The categories of Personal Data we collect in connection with the Rebate Program include: first and last name, phone number, address, email address, and invoice information such as purchase date, purchase price, invoice number, model number, and serial number of eligible appliances, and where the products were purchased. We use the Personal Data you provided to us when you submit Rebates to send you relevant messages about your rebate.
We estimate the value of the Personal Data you provided to us in connection with the Rebates is based on the amount you spent and the expenses incurred by Miele in connection with Rebates. This value varies based on the amount of discount offered at the time of participation, the amount of products purchased and the amount of expenses incurred by Miele. Based on our good faith estimate, the value of the Personal Data we collect through Rebates is reasonably related to the value of the financial incentive offered to the participants of the Rebates.
2. Changes to this Privacy Notice
We reserve the right to amend this State-Specific Notice at our discretion and at any time. When we make changes, we will post the updated notice’s effective date. Your continued use of our Website and applications following the posting of changes constitutes your acceptance of such changes.
