We do not seek to collect Sensitive Personal Data (or “Sensitive Personal Information”) as defined in applicable state privacy laws (“Sensitive Personal Data”) and do not intend to collect such information on and after the date of this Privacy Notice. Sensitive Personal Data includes any private information that divulges any of the following: information of a known child, personal identification numbers, including social security, driver's license, passport, or state ID card number; account or debit or credit card numbers combined with passwords or codes that would enable access to the accounts; a consumer's exact geolocation within 1850 feet or any inferences made from geolocation; a consumer's racial origin, religious beliefs, or union membership; a consumer's mail, email, or text message content unless the information was intentionally sent to the business, and a consumer's genetic data.

1.6 Retention of Personal Data (our “Retention Policy”)
Unless otherwise stated in this Privacy Notice as a general rule, Miele retains your Personal Data for as long as reasonably necessary and proportionate to the original purpose for collecting and processing it. Your Personal Data will be removed and/or de-identified when your Personal Data is no longer necessary for such purpose. We may also need to delete sooner or retain your Personal Data for a longer period if we have a reason of doing so pursuant to applicable law, rule, regulation, or an order from a government entity. • Legal representatives, government authorities, law enforcement representatives: We may use and/or disclose your Personal Information with and to third parties, such as legal and other professional advisors and law enforcement, to obtain advice, to enforce legal rights and comply with the law, to comply with an order from a court, state agency or other government entity or other competent authority, to comply with applicable law or regulatory action, or when we have reason to believe that a disclosure is necessary to address potential or actual injury or interference with our rights, property, operations, users or others who may be harmed or may suffer loss or damage and
• Other Legal purposes: We may use and/or disclose your Personal Data with and to any other recipient or party as allowable by applicable law.
1.8 “Sale” or “Sharing” of Personal Data
We do not sell Personal Data for monetary consideration. However, the activities described under “Analytics and behavioral advertising” may constitute as “sale” or “sharing” of Personal Data under certain state laws regardless of whether an exchange of monetary consideration takes place or not. To opt out of the sale of Personal Information, please visit Do Not Sell or Share My Personal Information.
The categories of Personal Information that California Law may consider as having been “sold” or “shared” by Miele include: identifiers, commercial information, internet or other network activity, geolocation, and inferences.
We do not knowingly sell the Personal Information of consumers under 18 years of age.
1.9 Analytics and behavioral advertising
We use third party tools for services offered by Google (e.g., Google Analytics), Meta, and YouTube. These third-party tools collect data through tracking technologies such as cookies, pixels or plug-ins. We have entered into a data processing agreement with each of these service providers to prohibit them from using Personal Data for other purposes other than such business purposes for which Miele engaged them. Nonetheless, we do not have control over such third party’s use of your Personal Data. Please visit their respective privacy policies to learn more about their practices and available opt-outs. Information on how to opt out of tracking or targeted advertising by our third-party analytics and advertising partners, including Google and Meta, please refer to the privacy settings or opt-out mechanisms provided by each respective provider, which can typically be found within their privacy policies or account settings. Miele is not responsible for your use or download of any opt-out tools provided by Google or any third party.
Where we work with other companies to engage in behavioral advertising, these companies are often members of the Digital Advertising Alliance (“DAA”) and/or the Network Advertising Initiative ("NAI"). These programs offer centralized locations where users can make choices about the use of their information for behavioral advertising. Opt-out preferences are saved on the specific browser and device you use, so you'll need to opt out separately on each one. Opting out through the Digital Advertising Alliance (DAA) or Network Advertising Initiative (NAI) tells their member companies to stop showing you ads based on your browsing behavior. 1.10 Data security
We implement and maintain reasonable and appropriate administrative, physical, and technical security safeguards designed to help protect the security and privacy of the Personal Data you have provided. Nevertheless, transmission via the internet is not completely secure and we cannot guarantee the security of your Personal Information.
To keep your Personal Data safe, we have implemented the following measures:

In order to fulfil your requests pursuant to the rights as stated, we may request specific additional information from you to verify your identity. We collect and process such requested Personal Data for the sole purpose of enabling us to respond to your request.
Please be informed that when you exercise certain rights mentioned (e.g., the right to deletion), we may no longer be able to offer you the use of the Website or portions thereof (e.g., access to your Miele Account may be limited).
We will remove your Personal Data within the period required by appliable law after you asked for a deletion of your Miele Account, unless we are required to delete such Miele Account sooner under applicable law, rule, or regulation. Should you decide to delete your Miele Account, please note that you will lose access to the Personal Data, courses, documents, and other information in your Miele Account. Miele is not under any obligation to maintain a back-up of such information and Personal Data.
2. Collection and processing related to our website
2.1 Automatically processed data when visiting
Each time you access our website, your browser automatically transmits data that are stored in the log files of the server. This includes the following data (hereinafter referred to as the "Log File Data"):
• Information about browser type and browser version;
• Operating system of the user;
• Internet service provider and IP address of the user; and
• Date and time of the access.
The Log File Data is evaluated anonymously in order to continuously improve the website, to adapt the website to the interests of our users and to be able to remedy errors quickly. For these purposes, our legitimate interest in the processing of data is pursuant to Art. 6 (1) (f) GDPR for individuals residing within the EU.
In a non-anonymised form, Log File Data are used solely to detect malfunctions and to ensure system security, including detection and tracking of improper access attempts and fraud and abuse attempts. In the event of technical errors or security incidents, we may also log the customer number and the shopping cart ID. The data are stored up to 30 days. In certain cases, Log File Data must be stored for a longer period, e.g. for troubleshooting or for preservation of evidence. In these cases, Log File Data will not be deleted until final clarification of the respective incident and may in individual cases be forwarded to the investigating authorities. For these purposes, our legitimate interest in the processing of data is pursuant to Art. 6 (1) (f) GDPR for individuals residing within the EU.
2.2 Registration for Miele Account
With a Miele Account, you can easily access all relevant information related to your orders, products, warranties, upcoming events and product services. All this information will be gathered and will be made available to you after your registration and login on the Miele website or in the Miele Apps.
We and Miele & Cie. KG are jointly responsible for data processing. You may contact us at any time if you have any questions or wish to exercise your rights as a data subject. Upon request, we will provide you with the main terms of the joint controller agreement between Miele & Cie. KG and us.
If you actively submit Personal data to us, for example by registering with a Miele Account, we will process the Personal data transmitted by you.
When registering for a Miele Account, we collect and process the following information from you:
• name;
• e-mail address;
• address;
• telephone number;
• password (encrypted);
• Account name;
• Other unique personal identifiers you provide when creating a Miele Account.
We process the above data to create and maintain a Miele Account. For individuals residing within the EU, the legal basis is Art. 6 (1) (b) GDPR.
If you submit your date of birth, we will process this to send you a personal birthday surprise by Email, Miele Apps or any other communication channel. For individuals residing within the EU, the legal basis is your consent, in accordance with Art. 6 (1) (a) GDPR. You may revoke any consent granted to us regarding the use of your data at any time with effect for the future. For this purpose, please use the contact details provided in section “Contact Information”.
We store your data during the existence of your Miele Account. Thereafter, we store your data only and insofar as we are obliged to store it for reasons based on commercial and tax law. For individuals residing within the EU, the legal basis is Art. 6 (1) (c) GDPR.
If and insofar you decided to register a Miele appliance through the Miele website or Miele App or to pair a network-enabled Miele appliance with your Miele Account, we will process the following data:
• Products or services purchased;
• Customer number and Miele account;
• Equipment serial number;
• Appliance manufacturing number;
• Functional characteristics of the appliances and appliance master data; and
• Purchase date.
We process the above data to provide you an overview of all of your registered or paired domestic appliances and/or, as applicable, to fulfil the services offered by Miele. For individuals residing within the EU, the legal basis is Art. 6 (1) (b) GDPR.
We store your data during the existence of your Miele Account. Thereafter, we store your data only and insofar as we are obliged to store it for reasons based on commercial and tax law. For individuals residing within the EU, the legal basis is Art. 6 (1) (c) GDPR.
2.3 Processed data when using the online shop
If you actively submit data to us, for example by using our online shop, we will process the data transmitted by you.
You can use our online shop as guest or registered user. When using the online shop, we collect and process the following information from you:
• Title;
• Name;
• Address;
• Email;
• Telephone number;
• Items ordered;
• Delivery interval and address, if different;
• Invoice and payment data (more on this below).
We process the above data to process your orders. If you signed up for a subscription, we will process the above data for each delivery.
For individuals residing within the EU, the legal basis is Art. 6 (1) (b) GDPR. When you use the online shop as registered user, we store the order history to your Miele Account; for example to present your recently purchased products. For individuals residing within the EU, the legal basis for this is Art. 6 (1) (b) GDPR.
We store the data collected for the contract until the expiry of the statutory or any contractual warranty and guarantee claims. Thereafter, we store the information required by commercial and tax law for the statutory periods of time for the sole purposes of an audit being performed by the tax authorities. For individuals residing within the EU, the legal basis is Art. 6 (1) (c) GDPR.
Your payment data will be forwarded to the respective payment service provider for payment processing.
We have assigned the following payment service providers; (i) Worldpay (UK) Limited, (ii) Worldpay Limited and (iii) Worldpay AP Ltd registered at The Walbrook Building 25 Walbrook, London EC4N 8AF, United Kingdom, www.worldpay.com and (iv) Adyen N.V., Simon Carmiggeltstraat 6-50, 1011 DJ, Amsterdam, the Netherlands, https://www.adyen.com/policies-and-disclaimer/privacy-policy, to process payments via Apple Pay, Google Pay, credit card and other payment methods on behalf of Miele. All credit card details are directly entered into the system of the respective payment provider and cannot be read or processed by us. If you pay via PayPal, you will be redirected to PayPal's website via a link. With regard to payment processing, the data processed relate to your name, your address, your Email address, any telephone number(s) and account or credit card information. If you pay via Klarna, you will be forwarded to the Klarna app, a service of the Klarna Bank AB (publ) Sveavägen 46, 111 34 Stockholm, Sweden. Regarding payment processing, the data processed relate to your name, your address, your Email address, any telephone numbers and account or credit card information. For individuals residing within the EU, the legal basis is Art. 6 (1) (b) GDPR.
In addition to the abovementioned processing purposes, we process your IP address for IT-security and fraud prevention purposes, in particular preventing and detecting of payment fraud. For fraud prevention purposes, we receive information from our payment service provider for payment risk assessments and to ensure safe services.
We also process your address (or delivery address, if different) data to validate your address. We process such data for fraud prevention purposes as well as to avoid and correct input errors. For individuals residing within the EU: We have a legitimate interest in such data processing, the legal basis is Art. 6 (1) (f) GDPR. We use a processor bound by instructions within the meaning of Art. 28 GDPR for data processing.
The delivery address will be forwarded to the delivery partner appointed by us. So that the delivery partner can contact you to coordinate the delivery date or in the case of delivery problems, we will provide the delivery partner with your Email address and, if applicable, telephone number. The respective data are transmitted solely for the respective purposes and are to be deleted by such partner after delivery.
For certain products, we offer a track-and-trace service. In this event, we will transfer your Email address and other data to our instruction-bound service provider. For individuals residing within the EU, the legal basis for the processing of the data is Art. 6 (1) (b) GDPR. Furthermore, we have legitimate interest in the proper delivery of your order, Art. 6 (1) (f) GDPR. The data will be processed as long as it is required for the track-and-trace service and is to be deleted by such provider afterwards.
2.4 Find a Dealer
We use the Google Maps map service via an API for our "Find a retailer" function. The provider is Google Inc. with its registered office at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as "Google").
If you consent to the use of our dealer search by clicking on the "Load Google content" button, your
• IP address;
• Address - if entered in the input field on the page; and
• Geolocation - if you click on the arrow icon next to the input field on the page and give or have given permission to share your (geo)location in your browser,
will be shared with Google so that the feature can show you a list of dealers, partners or other Miele-related locations near the location you have specified.
To save your decision for the current session and ensure that you have had this option, a session cookie with only this content (true/false value) is set. Further information can be found in our cookie policy.
We process your data in order to provide you with the services you have requested in accordance with Art. 6 (1) (b) GDPR (for EU residents) or equivalent provisions in non-EEA countries.
You can change the permission or non-permission to share your (geo)location in the privacy settings of your browser or on the website at any time
To revoke your consent to the processing of your data for the function, you only need to delete the cookies and reload the page or simply end the session.
Google LLC acts as its own data controller for your personal data and may use this data for its own purposes and transfer it to secure and insecure countries. 2.5 Collection service
In the event you are in default of payment despite repeated reminders, we reserve the right to forward the data required for the execution of a collection to a debt collection agency for the purpose of fiduciary collection or to sell the outstanding claims to a collection service provider. In the event of a sale, the collection service provider becomes the holder of the claim and asserts the claims in its own name.
2.6 Opt out Preference Signal - Global Privacy Control and Do Not Track
We honor your opt out preference signal. Your browser may allow you to set a signal, indicating that you do not wish your online activity to be tracked, signals such as the Global Privacy Control (GPC) or Do Not Track (DNT). The signals are opt-out preference signals that communicates your privacy preferences to websites you visit. We actively support, monitor, or respond to GPC and DNT signals that we receive. 2.7 Rebate programs
Miele provides certain rebate promotions to customers who have an account and purchase and subsequently register certain qualifying products and any additional qualifying appliances (“Rebates”). Miele may also use third party vendors, such as 360 Insights, to facilitate rebate programs and collect Personal Data on our behalf. The Personal Data is owned by Miele and the third-party vendors are “processors” under applicable law subject to Miele’s direction as a “controller.” When applying for Rebates, Miele or its third party vendor(s) will request that you provide your first and last name, phone number, address, email address, and invoice information such as purchase date, purchase price, invoice number, model number, and serial number of eligible appliances, and where the products were purchased for purpose of providing you with the requested Rebates. Third-party vendors use different methods to facilitate Rebates. These include account creation or phone support. You can delete any information provided by contacting the third-party vendor directly.
3. Commercial communication
If and insofar as you have given us your consent for marketing and advertising purposes, e.g. by subscribing to the newsletter, customer satisfaction surveys, app notification, etc., or if we are otherwise permitted to process your data for the aforementioned purposes on the legal basis of our legitimate interest (for EU residents), the data processing required in the context of establishing contact is carried out on the legal basis of your consent, Art. 6 (1) (a) GDPR or our legitimate interest, Art. 6 (1) (f) GDPR. It is possible that commercial communications may be sent through our external service providers. These service providers act as processors on our behalf. You may object to the processing of your data for these purposes or revoke your consent to us at any time with effect for the future (e.g. by using the unsubscribe link contained in the email or by writing to us by Email or letter).
We will check if the Email address you provided for receiving commercial mails is valid using a small request with your Email service provider (SMTP call). You won't receive any Emails as a result. We process your data to fulfil your requested service in a proper manor to an existing e-mail address.
3.1 Basic Consent based commercial communications
Miele offers a wide range of products and services. In order to provide you with information that is of interest to you, we use a personalization in our newsletter and our consent-based commercial communications (we use both terms synonymously).
Within the scope of consent-based commercial communication, we will inform you about products and innovations in the Miele product range, Miele offers, sweepstakes, events organized by Miele, customer surveys, product rating and review requests for purchased Miele products and recipes, all tailored to your interests. We will use the postcode you provide to inform you about Miele events in your area. In addition, when we send you commercial communications, we will take into account the interests you have indicated when registering for commercial communications or stating in your account, if this is available in your country.
If and insofar as you have given us your consent, we and Miele & Cie. KG, Carl-Miele-Str. 29, 33330 Gütersloh, Germany, process the contact data you have provided (Email address and name, your telephone number and/or your Miele account, if you have one) and the data groups listed below for the purpose of sending you personalized commercial communications by Email, SMS, post or via the Miele Apps and websites. We and Miele & Cie. KG are jointly responsible for data processing. You may contact us at any time if you have any questions or wish to exercise your rights as a data subject. Upon request, we will provide you with the main terms of the joint controller agreement between Miele & Cie. KG and us.
For individuals residing within the EU, the legal basis for this processing is your consent, Art. 6 (1) (a) GDPR.
We will process the contact data and your declaration of consent for the abovementioned purposes for 5 years after each use.
You may revoke your consent at any time for the future without giving reasons, by Contacting us. You will also find an unsubscribe link in every e-mail sent to you, which you can use to cancel your subscription. There is also an opt-out button in the settings of your Miele Account and App.
3.1.1 Purchasing, event and service histories
We will tailor our commercial communications to your interests/ needs. Therefore we take into account all Miele appliances or Miele products that you have already purchased directly from Miele and/or registered/paired in your Miele Account and those that you will purchase or register/ pair in the future, as well as any Miele events that you have booked. This includes reminders for warranty extensions and to redeem the consumables voucher included with your appliance. Miele will process your order history (also retrospectively where applicable) for a period of 10 years for appliances and 5 years for consumables and accessories.
We also use information about the services you have used in the past and will use in the future (e.g. delivery and/or installation service, maintenance work, individual product advice and contact with Miele's customer service) and the technician assignments you have commissioned. As part of the information on the technician assignments, Miele processes the details of the respective repair order, the cause of the damage and any remedial action taken (repair). We store this information for a period of 3 years.
3.1.2 Newsletter clicks and opens
In addition, we collect your receipts and read receipts of our commercial communications, as well as information about the links you click there. In addition we also process usage data from Miele apps and your visits to Miele websites. This includes how users interact with our Miele websites linked in the newsletter. We use customer lifetime value to gain a deeper understanding of our customers so that we can better target our advertising campaigns to your interests.
The specific customer lifetime value calculation is based on several factors. In order to create customer scores, we use your pseudonymized account information, analyze your purchasing and ordering behavior as well as newsletter clicks and opens as described above and create segments to certain customer value groups.

3.2 Appliance Usage for personalized advertising
If and insofar you have given us your explicit consent, we will process your appliances usage data in order to tailor our marketing activities based on your interest and usage behavior of connected Miele appliances. In this context, we will process the following data:

• Equipment serial number;
• Appliance manufacturing number;
• Functional characteristics of the appliances and appliance master data;
• Appliances data, including

• Personally identifiable features for telecommunications (e.g. IP-address).
We store this information for these purposes for 2 years.
You may revoke your consent at any time for the future without giving reasons, by Contacting us. You will also find an unsubscribe link in every e-mail sent to you, which you can use to cancel your subscription. There is also an opt-out button in the settings of your Miele Account and App.
3.3 Commercial after-sales contact
In cases where you have set up a Miele customer account and ordered goods or services we will also process your Email address and purchase history in order to send you advertisements for similar goods and/or services or customer satisfaction surveys, reviews and ratings relating to your purchases by Email in the future. You can request at any time to no longer receive such informational emails. 6. Product Rating and Reviews
On our website we use the services of Yotpo UK Ltd (Tagwright House, 35-41 Westland Place, London N1 7LP, United Kingdom), to collect and display ratings and reviews of customers for products they have purchased. We share the personal data described below to our affiliated entities Miele & Cie. KG and Miele X B.V. and to our service provider Yotpo, so that we can provide all the functionalities of these services. Miele & Cie. KG, Miele X B.V. and Yotpo act as a processor / sub-processor on our behalf and upon our instructions.
If you have provided us your consent for basic commercial communication, or as part of our commercial after-sales contact, we collect and process information that includes personal data, such as order ID, order date, and your Email address. This data is processed with the purpose of sending you Email communications, requesting you to provide rating and reviews regarding the products you have purchased. If you submit a review on our website, within the framework of these services, we collect and process information that includes personal data, such as review title, review content, order ID, order date, reviewed and purchased product, reviewer display name, reviewer Email address, and personal unsubscribe token. Published reviews will be displayed on the relevant product detail page on our website, on the websites of other entities of the Miele Group (Subsidiaries (miele.com)) and on websites of our partners and resellers who are promoting the same product. While certain reviews, such as kitchen appliances, may be kept for up to 20 years, the specific timeframe is determined by an evaluation of individual product attributes, popularity trends, and whether the product remains listed or is delisted. The legal basis for the data processing is our legitimate interest to collect and display ratings and reviews for our offered products you purchased, as agreed by your confirmation of our Terms of Use and further to confirm your legitimacy to rate and review these products and to prove authenticity. Our website lists different ways that you can contact us. Furthermore, you can contact us through our social media presences (e.g. on Facebook or Instagram). If you use these and contact us e.g. by Email, we will process the data you provided to us to answer your request.

On our website, we offer an AI-powered product recommendation tool (the “Buyer’s Guide”), provided by our service provider Neocom (Neo Commerce GmbH). The Buyer’s Guide uses artificial intelligence to help you find the right product faster and more efficiently. After answering a few questions, the tool generates personalized product suggestions ranked by how well each product fits your stated needs. Use of the Buyer’s Guide is entirely optional. The tool’s recommendations are generated by an automated system; they are not human-curated and may not account for all individual preferences. In this context, we only process meta data of an HTTP Web request as referrer, your IP-address, browser language and user agent (browser/ OS type & version) and your data shared with us by using the service. Your data is stored only for the duration of the session. We process your data to provide you the service. For residents of the EU, the legal basis for the processing is Art. (6) (1) (f) GDPR. On our website we use Hotjar by Hotjar Ltd (“Hotjar”), Dragonara Business Centre, 5th floor, Dragonara Road, Paceville St Julian’s STJ 3141 Malta, that provides Software as a Service (SaaS), a third-party analytics service, to help us understand how visitors engage with our website and to optimize this service and experience.
Hotjar may collect and process data on our behalf, including clicks, mouse movements, and scrolling activity, what users do and don’t like, information about your device and browser, IP address (collected and stored in an anonymized format), unique device identifiers, referring URL and domain, pages visited on, geographic location (country only), and the preferred language used to display our website. 7.6 Trade Desk Pixel
On our website, we use the Trade Desk Pixel, provided by The Trade Desk Ltd (“Trade Desk”), 10th floor, 1 Bartholomew Close, London EC1A 7BL, United Kingdom, a snippet of JavaScript code that allows us to track your activities on our website and facilitates the use of technology that helps us with digital advertising by a Demand Side Platform (“DSP”).
The purpose for processing the data is for advertising purposes including personalizing ads, delivering ads, limiting the number of times you see an ad, measuring effectiveness of ads, reporting on ad campaigns and maintaining ad transaction records.

The platform uses data to produce a mapping of devices that might be related to each other. This means that they might be used by the same person or by people within the same household. This helps us to better target and measure our campaigns, as well as to limit the number of times the same person or household sees an ad.
Trade Desk acts as a data processor, and we as a controller in accordance with the GDPR.
Trade Desk may collect and process pseudonymous data, on our behalf, about users, households, devices and ads and where they’re shown, including unique cookie identifiers, device advertising identifiers, pseudonymous identifiers derived from email address or phone numbers, IP addresses, interest and demographic information stored and/or used on the Platform, interest and demographic information they create or infer, other information about browsers and devices, such as type, version and settings, location information based on IP address or other types of information that may include precise geolocation information (i.e., latitude/longitude coordinates), if provided, the browser and device information type, version and settings, hashed email addresses and other identifying information (or information derived from such).
The data sent by us is retained by Trade Desk in a pseudonymized manner for up to 18 months. After 18 months (often sooner) the data is de-identified or aggregated and stored for up to 3 additional years.

7.7 Meta Services

Hashing is a process in which personal data is converted into a coded form before transmission. As both parties apply the same one-way hash function to the same data elements, Meta can compare the transmitted values with corresponding information derived from its own user data. When Miele provides Meta with hashed data of a selected customer group, Meta can match this data with its platform users in order to specifically target Miele customers who use these platforms with relevant advertising based on demographic and other factors selected by Miele. In addition, this matching may support the delivery, measurement, and ongoing improvement of Meta’s advertising systems. Miele only transmits the hashed value and no additional information about you to Meta; however, Meta may link this information with existing data it holds about you.

Our website includes an AI-powered shopping assistant (the “Assistant”). The Assistant is powered by artificial intelligence and is provided by our service provider Microsoft Ireland Operations Limited, Dublin, Ireland, who acts as a processor on our behalf and upon our instructions. The Assistant uses AI to help you discover suitable products and compatible accessories by interpreting your questions or uploaded images. It may ask for certain details, such as your household size, home type, or product model, to provide you with explanations and guidance on products. The Assistant’s responses are generated by an automated AI system and may not always be accurate; they do not constitute professional advice. The input of special categories of personal data (Art. 9 GDPR for EU residents), such as health data, is not necessary for the use of the assistant. Please do not submit sensitive personal information such as health data, Social Security numbers, or financial account information when using the Assistant.
When using the Assistant, your messages and uploaded images are temporarily processed by the AI maintain the conversation during your session. This data is held only for the duration of your session and is automatically deleted when the session ends. It is not stored or retained beyond that point. Your IP address is processed to technically enable the feature and ensure proper functioning. Assistant is only activated—and your data is only processed—when you choose to interact with it. In connection with this service, we use cookies and session or local storage technologies to ensure proper technical functionality of the Assistant. Such an evaluation is carried out in particular (also for non-logged-in users) for the presentation of needs-based advertising and to inform other users of the social network about your activities on our website. 11. Miele digital products and services

12. User generated content
When you tag us in your content on social media or otherwise provide content to us (such as photos or videos), it might be possible that we seek your consent to use such content, including without limitation to repost your content on our social media channel/s (e.g. on Facebook, Instagram, YouTube, X and others). We will only use your content after we received your explicit consent. In order to do so, we process your content, your username / account name on social media, your Email address and further information you share with us, e.g. your name. The legal basis for the processing of your data is your consent. The data are stored by us only as long as it is necessary for the fulfilment of the respective purpose, unless otherwise provided for by the applicable legislation. You may revoke your consent at any time with effect for the future.
13. Job application
If you apply via the Miele application portal or form or otherwise for a position with us and send us application documents, we will process or cause the Personal Data you provide to be processed by a service provider only for the purpose of the application process. We note that only the service provider(s) we engage to process the Personal Data of applicants have access to the Personal Data and we have a data processing agreement in place that prohibits them from using such Personal Data for purposes other than those we engaged them for.
Insofar as you have applied for an advertised position or unsolicited application, the application will be kept for a minimum period of one year in order to contact you, if necessary, with regard to a vacancy notice that arises. At any time, you have the option of requesting the deletion of your application. In the case of a successful application, the transmitted data will be stored for the purpose of the employment relationship in compliance with the legal requirements.
If you have applied for employment with another Miele Group company, we will forward your application to the respective company for the purpose of deciding on the employment relationship.
Your Personal Data will not be sold to or shared with third parties, nor will it be processed for targeted advertising or profiling. Neither do we offer financial incentives to process this Personal Data.
14. Miele trade fair presence
If you visit one of our booths, we collect your data if you provide us with such, e.g. by handing over your business card. We process these data to respond to your concern, e.g. contact for further discussions or offers. If this is necessary to respond to your concern (e.g. when requesting a contact abroad), we will forward your data to the responsible person of the respective company of the Miele Group. We note that we only process such Personal Data for business to business transactions (i.e., no targeted advertising or profiling).
When contacting us, data transmitted to us will be deleted after completion of your request, provided and insofar as we are not obliged to store it for reasons based on commercial and tax law.
At our booths, we also occasionally take pictures and film recordings for documentation, marketing and press purposes, which are then published via our social media channels (e.g. Facebook, YouTube or Instagram). In this case, we expressly point this out to you by posting a notice on the stand. You may revoke any consent granted to us regarding the use of such an image at any time with effect for the future.

Although some of these rights apply generally, many of these rights will only apply to limited individuals or circumstances. To the extent that these laws apply, you may exercise the following rights:
15.2.1 Right to know and right to access
You have a right to know how we process and share your Personal Data, which is described in this Privacy Notice. You may also have the right to request that we disclose certain information to you about our collection and use of your Personal Data. Once we receive your request and confirm your identity, we will disclose to you, where required by law:

15.2.2 Right to correct
You have the right to request that we correct your Personal Data if you think they are inaccurate, taking into account the nature of the Personal Data and the purposes of processing of the Personal Data. Upon your verified request , we will use commercially reasonable efforts to correct your Personal Data and will direct our service providers to do the same.
15.2.3 Right to delete
You have the right to request that we delete the Personal Data that we have collected from you and retained, subject to certain exceptions. We will use commercially reasonable efforts to honor your request, in compliance with applicable laws. Please note, however, that we may need to keep such information if an exemption applies. Below is a list of such exemptions. Once we receive your verified request, we will delete your Personal Data (unless an exemption applies) and will direct our service providers to do the same.
Where allowable by law, we may deny your deletion request if retaining the Personal Data is necessary for us or our service provider(s) to:
• Complete the transaction for which we collected the Personal Data, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with applicable law, or otherwise perform our contract with you;

• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; and/or
• Comply with a legal obligation.
15.2.4 Right to Data Portability
You may be entitled to receive the Personal Data that you have provided to us in a structured, common and machine-readable format and to transmit it to another business or entity.
15.2.5 Right to opt out of targeted advertising or profiling
You may opt-out of our use of your Personal Data for targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects. We may use Personal Data to create consumer profiles for purposes of personalizing your experience and delivering targeted marketing. These profiling activities involve analyzing your browsing behavior, purchase history, and product interactions to infer preferences and interests. We do not currently use profiling to make decisions that produce legal or similarly significant effects concerning you. If our practices change, we will update this notice accordingly.
15.2.6 Right to opt-out of sale to or sharing with third parties
You have the right to direct us to stop disclosing your Personal Data to third parties for monetary or other valuable consideration such as cross-contextual behavioral advertising. At any time, you can also use our cookie preference tools to manage what kinds of cookies and other tracking technologies you’re comfortable with. California Law provides its residents with a right to limit the use and disclosure of Sensitive Personal Data. However, we do not currently collect, use or disclose Sensitive Personal Data triggering California Law’s opt-out requirements.
15.3 Other State Rights
15.3.1 California Privacy Rights
Pursuant to California’s “Shine the Light” law, California residents who share Personal Data with us have the right to request and obtain from us once per year, free of charge, a list of the third parties to whom we have disclosed their Personal Data (if any) for direct marketing purposes in the prior calendar year, as well as the type of Personal Data disclosed to those parties. If you would like to exercise this right, please use the contact information listed under Section “Contact Information”. We note that without your explicit consent Miele does not disclose your Personal Data to third parties for such third parties’ own marketing purposes.
15.3.2 Nevada Privacy Rights
Nevada Law provides its residents with a limited right to opt-out of the sale of Personal Data following Chapter 603A of the Nevada Revised Statutes. Residents who wish to exercise such opt-out right may submit a request by contacting us via email at dataprotectionus@mieleusa.com. However, please note that we do not currently sell Personal Data triggering the statute’s opt-out requirements.

Only you, or an authorized agent acting on your behalf, may make a verifiable consumer request related to your Personal Data. If you use an authorized agent, we may require the agent to provide: (a) a signed, written authorization from you; (b) proof of the agent’s registration with the applicable Secretary of State (if a business); or (c) a valid power of attorney pursuant to applicable state law. We may also require you to verify your own identity directly with us and confirm that you authorized the agent to act on your behalf. You may only make a verifiable consumer request for access or data portability twice within a 12-month period and a request pursuant to California’s “Shine the Light” law once during the course of a calenda year.
The verifiable consumer request must:
• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative. Such information or documentation may include:
o Certain Personal Data about you that we have on file (e.g., postal address) or information related to the purchases you made on the Website.
o Certain information or certification showing our authority or relationship to the person on whose behalf you are submitting the request.
o Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
Where we are entitled or required to verify your identity under the applicable state privacy law, we cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you. In such case, we will inform you that your identity cannot be verified.
Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
15.5 Response timing and format
We will confirm receipt of your verifiable consumer request within ten (10) business days after receiving your request and provide information about how we will process it. We respond to a verifiable consumer request no later than forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. For requests under California’s Shine the Light Law (see below), we will respond within thirty (30) days of receipt of your request.
We will deliver our written response by mail or electronically, at your option (depending on how you make your request).
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily usable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
15.6 Appealing Privacy Rights Decisions
Depending on your state of residency, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted via email to dataprotectionus@mieleusa.com. We will respond to your appeal within forty-five (45) days of receipt. If we deny your appeal, we will provide you with a written explanation of the reasons for the denial. You may also have the right to contact your state attorney general to lodge a complaint. Non-discrimination
We will not discriminate against you for exercising any of your rights pursuant to Privacy Notice. Unless permitted by law, we will not:
• Deny you goods or services;
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
• Provide you a different level or quality of goods or services; or
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
15.7 Minors
We do not sell or share the Personal Data of consumers we know to be less than 16 years of age without affirmative authorization. For consumers under 13 years of age, a parent or guardian must provide affirmative authorization. For consumers aged 13 to 15, the consumer themselves must provide affirmative authorization. These protections apply to sales and sharing for cross-context behavioral advertising as defined under applicable law. If you wish to remove the name or comments of your minor child from our website or publicly displayed content, please contact us directly at dataprotectionus@mieleusa.com. We may not be able to modify or delete your information in all circumstances.
If you wish to submit a privacy request on behalf of your minor child in accordance with applicable jurisdictional laws, you must provide sufficient information to allow us to reasonably verify your child is the person about whom we collected Personal Data and you are authorized to submit the request on your child’s behalf (i.e., you are the child’s legal guardian or authorized representative).
15.8 Notice of Financial Incentives
Use of Rebates is subject to the terms, conditions and limitations stated on the sign-up window as may be amended by Miele from time to time. You can also find such example terms on the Rebate Redemption section of the website.
The promotions provided to you under the Rebates may be deemed as a “financial incentive” under applicable laws. The categories of Personal Data we collect in connection with the Rebate Program include: Name, postal address, phone number, email address, applicable appliance(s) serial numbers, and proof of purchase, delivery and installation. We use the Personal Data you provided to us when you submit Rebates to send you relevant messages about your rebate.
We estimate the value of the Personal Data you provided to us in connection with the Rebates is based on the amount you spent and the expenses incurred by Miele in connection with Rebates. This value varies based on the amount of discount offered at the time of participation, the amount of products purchased and the amount of expenses incurred by Miele. Based on our good faith estimate, the value of the Personal Data we collect through Rebates is reasonably related to the value of the financial incentive offered to the participants of the Rebates.
Our valuation methodology is based on the expense-related method, taking into account the costs we incur in collecting, storing, and using the Personal Data in connection with the Rebate Program. You may opt in to the Rebate Program by submitting a rebate claim through our website or authorized channels. You may withdraw from the program at any time by contacting us at dataprotectionus@mieleusa.com, and we will cease using your Personal Data for rebate-related purposes, though we may retain it as necessary to comply with legal obligations.
15.9 De-Identification Practices
Where we de-identify Personal Data, we maintain and use such information in de-identified form and will not attempt to re-identify the information, except for the purpose of determining whether our de-identification processes are adequate. We implement technical safeguards and business processes that prohibit re-identification, and we contractually require recipients of de-identified data to comply with these requirements.
